The purpose of the personal data protection policy is to inform individuals, service users, colleagues and employees and other persons (hereinafter: data subject) who cooperate with the Bogen\u0161perk Public Institute (hereinafter: public institute) about the purposes and legal bases, security measures and rights of individuals regarding the processing of personal data carried out by the public institute.<\/p>\n
At the public institute, we respect your privacy, therefore we process personal data in accordance with European legislation (Regulation (EU) 2016\/697 on the protection of individuals with regard to the processing of personal data and on the flow of such data (hereinafter: General Regulation)) and applicable legislation in the field of personal data protection (Personal Data Protection Act (ZVOP-2, Official Gazette of the Republic of Slovenia, No. 163\/22 and 40\/25 \u2013 ZinfV-1)) and other legislation that gives us a legal basis for the processing of personal data.<\/p>\n

Authorised person<\/strong><\/p>\n The Data Protection Officer is responsible for supervising the proper processing of your personal data. In accordance with Article 37 of the General Regulation, the Data Protection Officer is:<\/p>\n Mateja Krvina Personal data means any information relating to an identified or identifiable natural person (hereinafter referred to as the data subject); an identifiable natural person is one who can be identified, directly or indirectly, in particular by reference to an identifier such as a name, an identification number, location data, an online identifier or to one or more factors specific to the physical, physiological, genetic, mental, economic, cultural or social identity of that natural person.<\/p>\n Purposes of processing and grounds for processing<\/strong> Fulfillment of a legal obligation or performance of a task in the public interest<\/p>\n Based on the provisions of the law, the organization primarily processes data about its employees, which is enabled by labor legislation. Thus, based on the legal obligation, the organization primarily processes the following types of personal data: name and surname, gender, date of birth, EM\u0160O, tax number, place, municipality and country of birth, citizenship, place of residence for the purposes of implementing the employment contract and obligations under this title.<\/p>\n The legal basis for the processing of personal data of individuals is also: the Public Sector Wage System Act, the Cultural Heritage Protection Act, the Institutions Act, the Act on the Realization of the Public Interest in Culture, the Civil Servants Act, the Employment Relationships Act.<\/p>\n In limited cases, the processing of personal data within an organization is also permissible on the basis of public interest.<\/p>\n If you conclude a specific contract with an organization, this constitutes the legal basis for the processing of personal data. We may process your personal data in order to conclude and perform a contract, such as ticket sales, membership in an association, provision of training, service contract, etc. If an individual does not provide personal data, the organization cannot conclude a contract, nor can the organization provide you with a service or deliver goods or other products in accordance with the concluded contract, as it does not have the necessary data for the performance. The organization may, on the basis of performing a lawful activity, inform individuals and users of its services about its services, events, training, offers and other content to their email address. An individual may at any time request the termination of such communication and processing of personal data and cancel the receipt of messages via the unsubscribe link in the received message, or as a request by email to info@bogensperk.si or by regular mail to the organization’s address.<\/p>\n The legitimate interest ground is limited to processing by public authorities in the performance of their tasks. However, an organisation may also process personal data on the basis of a legitimate interest pursued by the organisation to a limited extent. The latter is not permissible where such interests are overridden by the interests or fundamental rights and freedoms of the data subject which require the protection of personal data. In the case of the application of legitimate interest, the organisation shall always carry out an assessment in accordance with the GDPR.<\/p>\n As a result, we may from time to time inform individuals about services, events, training, offers and other content via email, telephone calls and ordinary mail. An individual may at any time request to cease such communications and processing of personal data and to opt-out of receiving communications via the unsubscribe link in the communication received, or as a request by email to info@bogensperk.si or by regular mail to the organisation’s address.<\/p>\n If the organisation does not have a legal basis based on the law, the performance of a public task, a contractual obligation or a legitimate interest, it may ask the individual for consent. It may also process certain personal data of the data subject for the following purposes where the data subject has given his or her consent:<\/p>\n If the data subject has given consent to the processing of personal data and at some point no longer wishes to do so, he or she may request that the processing of personal data be stopped by sending a request by e-mail to info@bogensperk.si or by regular mail to the address of the organisation.<\/p>\n The processing is necessary to protect the vital interests of the data subject<\/p>\n The organisation may process the personal data of a data subject insofar as this is necessary to protect his or her vital interests. For example, the organisation may search for a personal document of the data subject, check whether that person exists in its database, examine his\/her medical history or contact his\/her relatives without the need for the consent of the data subject. The above applies in cases where it is strictly necessary to protect the vital interests of the individual.<\/p>\n Public Institution Bogen\u0161perk has video surveillance. Video surveillance (cameras are installed around the entrances to Bogen\u0161perk Castle) is used to monitor entrances and exits to and from the premises (pursuant to Article 77 ZVOP-2). Video surveillance is also carried out for the purpose of protecting individuals (users, employees and visitors) and the property and cultural heritage of the organisation (on the basis of legitimate interest as defined in Article 6(1)(f) of the General Regulation, in conjunction with Articles 76 et seq. of ZVOP-2). Video surveillance is carried out within certain work areas where it is strictly necessary for the safety of people or property or cultural heritage. Video surveillance will assist us in detecting, handling or resolving incidents, incidents, crimes, claims for damages or other claims. Recordings are kept for 30 days. We do not carry out video surveillance in a way that would have a particular processing impact. Neither does video surveillance allow for unusual further processing, such as transfers to third country entities, the possibility of audio intervention in the event of live monitoring of events.<\/p>\n Video surveillance allows the monitoring of live events by an authorised person. All information concerning the implementation of video surveillance can be obtained by contacting the organisation’s telephone number or e-mail address. The rights of individuals are described in this Privacy Policy. You can also contact the Data Protection Officer if you have any further questions.”<\/p>\n The organisation will keep personal data only for as long as necessary to fulfil the purpose for which the personal data were collected and processed. If the organisation processes the data on the basis of a law, the organisation will keep the data for the period prescribed by the law. In this respect, some data will be kept for the duration of the cooperation with the organisation and some data must be kept permanently.<\/p>\n Personal data processed by the organisation on the basis of a contractual relationship with an individual will be kept by the organisation for the period necessary for the performance of the contract and for 6 years after its termination, except in cases where there is a dispute between the individual and the organisation in relation to the contract. In such a case, the organisation shall keep the data for 5 years after the final decision of a court, arbitration or court settlement or, if there has been no court settlement, for 5 years from the date of amicable settlement of the dispute.<\/p>\n Those personal data processed by the organisation on the basis of the individual’s personal consent or legitimate interest will be retained by the organisation until the consent is withdrawn or until the data are requested to be erased. Upon receipt of a revocation or a request for deletion, the data shall be deleted within 15 days at the latest. The organisation may also delete the data prior to revocation where the purpose of the processing of personal data has been achieved or where required by law.<\/p>\n Exceptionally, an organisation may refuse a request for erasure on the grounds set out in the General Regulation, such as the following: the exercise of the right to freedom of expression and information, compliance with a legal obligation to process, grounds of public interest in the field of public health, archiving purposes in the public interest, scientific or historical research purposes or statistical purposes, the exercise or defence of legal claims.<\/p>\n After the retention period has expired, the controller shall erase or anonymise the personal data effectively and permanently so that they can no longer be associated with a specific individual.<\/p>\n The Organisation may entrust a contractual processor with the processing of personal data on the basis of a contractual processing agreement. Contract processors may process the entrusted data exclusively on behalf of the controller, within the limits of the controller’s authorisation, which is enshrined in a written contract or other legal act and in accordance with the purposes set out in this Privacy Policy.<\/p>\n The contractual processors with which the Provider cooperates are, in particular:<\/p>\n In no case will the Organisation disclose the personal data of an individual to unauthorised third parties.<\/p>\n Contract processors may only process personal data within the framework of the instructions of the organisation and may not use personal data for any other purpose.<\/p>\n The Organisation, as controller, and its employees do not export personal data to third countries (outside the Member States of the European Economic Area – EU Member States plus Iceland, Norway and Liechtenstein) and to international organisations, except to the USA, where the relationship with US contract processors is governed by standard contractual clauses (standard contracts adopted by the European Commission) and\/or binding corporate rules (adopted by the Organisation and approved by the supervisory authorities in the EU).<\/p>\n The organisation ensures information and infrastructure security (premises and application system software). Our information systems are protected by, among other things, antivirus and firewalls. We have put in place appropriate organisational and technical security measures to protect your personal data against accidental or unlawful destruction, loss, alteration, unauthorised disclosure or access and against other unlawful and unauthorised forms of processing. In the case of the provision of special types of personal data, we provide them in encrypted and password-protected form.<\/p>\n It is your responsibility to provide us with your personal data securely and to ensure that the data provided is accurate and authentic. We will endeavour to ensure that the personal data we process about you is accurate and, where necessary, kept up to date, and we may contact you from time to time to confirm the accuracy of your personal data.<\/p>\n In accordance with the General Regulation, an individual has the following rights regarding the protection of personal data:<\/p>\n Access to your personal data and exercised rights is free of charge for you. However, we may charge a reasonable fee if the data subject’s request is manifestly unfounded or excessive, in particular if it is repetitive. In such a case, we may also refuse the request.<\/p>\n If you exercise your rights under this heading, we may need to request certain information from you to help us confirm your identity, which is only a precautionary measure to ensure that personal data is not disclosed to unauthorised persons.<\/p>\n You can also use the Information Commissioner’s form available on their website to exercise your rights under this heading. Tako organizacija na podlagi zakonske obveznosti obdeluje predvsem naslednje vrste osebnih podatkov: ime in priimek, spol, datum rojstva, EM\u0160O, dav\u010dna \u0161tevilka, kraj, ob\u010dino in dr\u017eavo rojstva, dr\u017eavljanstvo, prebivali\u0161\u010de za potrebe izvajanja pogodbe o zaposlitvi in obveznosti iz tega naslova.<\/p>\r\n Pravna podlaga za obdelavo osebnih podatkov posameznikov pa je tudi: Zakon o sistemu pla\u010d v javnem sektorju, Zakon o varstvu kulturne dedi\u0161\u010dine, Zakona o zavodih, Zakona o uresni\u010devanju javnega interesa za kulturo, Zakon o javnih uslu\u017ebencih, Zakon o delovnih razmerjih.<\/p>\r\n V omejenih primerih je v organizaciji dopustna obdelava osebnih podatkov tudi na osnovi javnega interesa.<\/p>\r\n Izvajanje pogodbe<\/strong><\/p>\r\n V primeru, ko z organizacijo sklenete dolo\u010deno pogodbo, ta predstavlja pravno podlago za obdelavo osebnih podatkov. Va\u0161e osebne podatke smemo tako obdelovati za sklenitev in izvajanje pogodbe, kot je npr. prodaja vstopnic, \u010dlanstvo v dru\u0161tvu, izvedba izobra\u017eevanj, pogodba o izvajanju storitev ipd. \u010ce posameznik osebnih podatkov ne posreduje, organizacija ne more skleniti pogodbe, prav tako vam organizacija ne more izvesti storitve oziroma dostaviti blaga ali drugih produktov v skladu s sklenjeno pogodbo, saj nima potrebnih podatkov za izvedbo. Organizacija lahko na podlagi opravljanja zakonite dejavnosti posameznike in uporabnike njenih storitev na njihov elektronski naslov obve\u0161\u010da o svojih o storitvah, dogodkih, izobra\u017eevanjih, ponudbah in drugih vsebinah. Posameznik lahko kadarkoli zahteva prekinitev tovrstnega komuniciranja in obdelave osebnih podatkov ter prekli\u010de prejemanje sporo\u010dil preko povezave za odjavo v prejetem sporo\u010dilu, ali kot zahtevek po elektronski po\u0161ti na info@bogensperk.si ali z redno po\u0161to na naslov organizacije.<\/p>\r\n Zakoniti interes<\/strong><\/p>\r\n Uveljavljanje pravne podlage zakonitega interesa je sicer omejena za obdelavo s strani javnih organov pri opravljanju njihovih nalog. Vseeno pa lahko organizacija osebne podatke obdeluje tudi na podlagi zakonitega interesa, za katerega si organizacija prizadeva v omejenem obsegu. Slednje ni dopustno, kadar nad takimi interesi prevladajo interesi ali temeljne pravice in svobo\u0161\u010dine posameznika, na katerega se nana\u0161ajo osebni podatki, ki zahtevajo varstvo osebnih podatkov. V primeru uporabe zakonitega interesa organizacija vedno opravi presojo skladno s Splo\u0161no uredbo.<\/p>\r\n Tako lahko posameznike ob\u010dasno obve\u0161\u010damo o storitvah, dogodkih, izobra\u017eevanjih, ponudbah in drugih vsebinah preko elektronske po\u0161te, preko telefonskih klicev in po navadni po\u0161ti. Posameznik lahko kadarkoli zahteva prekinitev tovrstnega komuniciranja in obdelave osebnih podatkov in prekli\u010de prejemanje sporo\u010dil preko povezave za odjavo v prejetem sporo\u010dilu, ali kot zahtevek po elektronski po\u0161ti na info@bogensperk.si ali z redno po\u0161to na naslov organizacije.<\/p>\r\n Obdelava na podlagi privolitve<\/strong><\/p>\r\n V kolikor organizacija nima pravne podlage izkazane na osnovi zakona, opravljanja javne naloge, pogodbene obveznosti ali zakonitega interesa, sme posameznika zaprositi za privolitev. Tako lahko obdeluje dolo\u010dene osebne podatke posameznika tudi za naslednje namene, kadar posameznik poda za to soglasje:<\/p>\r\n \u010ce posameznik poda soglasje za obdelavo osebnih podatkov in v nekem trenutku tega ve\u010d ne \u017eeli, lahko zahteva prekinitev obdelave osebnih podatkov z zahtevkom po elektronski po\u0161ti na info@bogensperk.si ali z redno po\u0161to na naslov organizacije.<\/p>\r\n Obdelava je potrebna za za\u0161\u010dito \u017eivljenjskih interesov posameznika<\/strong><\/p>\r\n Organizacija lahko obdeluje osebne podatke posameznika, na katerega se nana\u0161ajo osebni podatki, v kolikor je to nujno za za\u0161\u010dito njegovih \u017eivljenjskih interesov. Tako lahko organizacija poi\u0161\u010de osebni dokument posameznika, preveri ali ta oseba obstaja v njegovi zbirki podatkov, preu\u010di njegovo anamnezo ali nave\u017ee stik z njegovimi svojci za kar organizacija ne potrebujete njegove privolitve. Navedeno velja v primeru, ko je to nujno potrebno za za\u0161\u010dito \u017eivljenjskih interesov posameznika.<\/p>\r\n V Javnem zavodu Bogen\u0161perk izvajamo videonadzor. S pomo\u010djo videonadzora (kamere so name\u0161\u010dene v okolici vhodov v grad Bogen\u0161perk) spremljamo vstope v prostore in izstope iz njih (na podlagi 77. \u010dlena ZVOP-2). Videonadzor pa izvajamo tudi za namen varovanja posameznikov (uporabnikov, zaposlenih in obiskovalcev) ter premo\u017eenja in kulturne dedi\u0161\u010dine organizacije (na podlagi zakonitega interesa, kot ga dolo\u010da to\u010dka (f) 1. odstavka 6. \u010dlena Splo\u0161ne uredbe, v povezavi s 76. in naslednjimi \u010dleni ZVOP-2). Znotraj nekaterih delovnih prostorov se videonadzor izvaja, kjer je to nujno potrebno za varnost ljudi ali premo\u017eenja oz. kulturne dedi\u0161\u010dine . Videonadzor nam bo v pomo\u010d pri odkrivanju, obravnavi ali re\u0161evanju inciden\u010dnih oz. izrednih dogodkov, kaznivih dejanj, od\u0161kodninskih ali drugih zahtevkov. Posnetki se hranijo 30 dni. Videonadzora ne izvajamo na na\u010din, ki bi imel poseben vpliv obdelave. Prav tako videonadzor ne omogo\u010da neobi\u010dajne nadaljnje obdelave, kot so prenosi subjektom v tretje dr\u017eave, mo\u017enost zvo\u010dne intervencije v primeru spremljanja dogajanja v \u017eivo.<\/p>\r\n Videonadzor omogo\u010da spremljanje dogajanja v \u017eivo s strani poobla\u0161\u010dene osebe. Vse informacije glede izvajanja videonadzora lahko pridobite na telefonski \u0161tevilki oz. elektronskem naslovu organizacije. Pravice posameznikov so opisane v tej Politiki zasebnosti. Dodatna vpra\u0161anja lahko naslovite tudi na poobla\u0161\u010deno osebo za varstvo podatkov.\u00ab<\/p>\r\n Organizacija bo hranila osebne podatke le toliko \u010dasa, dokler bo to potrebno za uresni\u010ditev namena, zaradi katerega so bili osebni podatki zbrani in obdelovani. V kolikor organizacija podatke obdeluje na podlagi zakona, jih bo organizacija hranila za obdobje, ki ga predpisuje zakon. Pri tem se nekateri podatki hranijo za \u010dasa sodelovanja z organizacijo, nekatere podatke pa je treba hraniti trajno.<\/p>\r\n Osebne podatke, ki jih organizacija obdeluje na osnovi pogodbenega odnosa s posameznikom, organizacija hrani za obdobje, ki je potrebno za izvr\u0161itev pogodbe in \u0161e 6 let po njenem prenehanju, razen v primerih, ko pride med posameznikom in organizacijo do spora v zvezi s pogodbo. V takem primeru hrani organizacija podatke \u0161e 5 let po pravnomo\u010dnosti sodne odlo\u010dbe, arbitra\u017ee ali sodne poravnave ali, \u010de sodnega spora ni bilo, 5 let od dneva mirne razre\u0161itve spora.<\/p>\r\n Tiste osebne podatke, ki jih organizacija obdeluje na podlagi osebne privolite posameznika ali zakonitega interesa, bo organizacija hranila do preklica privolitve ali do zahteve do izbrisa podatkov. Po prejemu preklica ali zahteve za izbris se podatki izbri\u0161ejo najkasneje v 15 dneh. Organizacija lahko te podatke izbri\u0161e tudi pred preklicem, kadar je bil dose\u017een namen obdelave osebnih podatkov ali \u010de tako dolo\u010da zakon.<\/p>\r\n Izjemoma lahko organizacija zavrne zahtevo za izbris iz razlogov iz Splo\u0161ne uredbe, kot so na\u0161teti: uresni\u010devanje pravice do svobode izra\u017eanja in obve\u0161\u010danja, izpolnjevanje pravne obveznosti obdelave, razlogi javnega interesa na podro\u010dju javnega zdravja, nameni arhiviranja v javnem interesu, znanstveno- ali zgodovinskoraziskovalne nameni ali statisti\u010dni nameni, izvajanje ali obramba pravnih zahtevkov.<\/p>\r\n Po preteku obdobja hrambe upravljavec osebne podatke u\u010dinkovito in trajno izbri\u0161e ali anonimizira, tako da jih ni ve\u010d mogo\u010de povezati z dolo\u010denim posameznikom.<\/p>\r\n Organizacija lahko za posamezne obdelave osebnih podatkov na osnovi pogodbe o pogodbeni obdelavi zaupa pogodbenemu obdelovalcu. Pogodbeni obdelovalci lahko zaupane podatke obdelujejo izklju\u010dno v imenu upravljavca, v mejah njegovega pooblastila, ki je zapisan v pisni pogodbi oziroma drugem pravnem aktu in skladno z nameni, ki so opredeljeni v tej politiki zasebnosti.<\/p>\r\n Pogodbeni obdelovalci, s katerimi sodeluje ponudnik so predvsem:<\/p>\r\n Organizacija v nobenem primeru ne bo posredovala osebnih podatkov posameznika tretjim nepoobla\u0161\u010denim osebam.<\/p>\r\n Pogodbeni obdelovalci smejo osebne podatke obdelovati zgolj v okviru navodil organizacije in osebnih podatkov ne smejo uporabiti za katerekoli druge namene.<\/p>\r\n Organizacija kot upravljavec in njeni zaposleni osebnih podatkov ne izna\u0161ajo v tretje dr\u017eave (izven dr\u017eav \u010dlanic Evropskega gospodarskega prostora \u2013 \u010dlanice EU ter Islandija, Norve\u0161ka in Liechtenstein) in v mednarodne organizacije, razen v ZDA, pri so \u010demer razmerja s pogodbenimi obdelovalci iz ZDA urejena na podlagi standardnih pogodbenih klavzul (tipske pogodbe, ki jih je sprejela Evropska komisija) in\/ali zavezujo\u010dih poslovnih pravil (ki jih sprejme organizacija in potrdijo nadzorni organi v EU).<\/p>\r\n Organizacija skrbi za informacijsko varnost in varnost infrastrukture (prostorov in aplikativno sistemske programske opreme). Na\u0161i informacijski sistemi so med drugim za\u0161\u010diteni s protivirusnimi programi in po\u017earnim zidom. Uvedli smo ustrezne organizacijsko tehni\u010dne varnostne ukrepe, namenjene varstvu va\u0161ih osebnih podatkov pred naklju\u010dnim ali nezakonitim uni\u010denjem, izgubo, spreminjanjem, nepoobla\u0161\u010denim razkrivanjem ali dostopom ter pred drugimi nezakonitimi in nepoobla\u0161\u010denimi oblikami obdelave. V primeru posredovanja posebnih vrst osebnih podatkov, jih posredujemo v \u0161ifrirani obliki in za\u0161\u010ditene z geslom.<\/p>\r\n Sami ste odgovorni, da nam svoje osebne podatke posredujete varno in da so posredovani podatki to\u010dni in verodostojni. Vendar pa lahko zara\u010dunamo razumno pla\u010dilo, v kolikor je zahteva posameznika, na katerega se nana\u0161ajo osebni podatki, o\u010ditno neutemeljena ali pretirana, zlasti \u010de se ponavlja. V tak\u0161nem primeru lahko zahtevo tudi zavrnemo.<\/p>\r\n V primeru uveljavljanja pravic iz tega naslova bomo morda morali od vas zahtevati dolo\u010dene informacije, ki nam bodo pomagale pri potrditvi va\u0161e identitete, kar je le varnostni ukrep, ki zagotavlja, da se osebni podatki ne razkrijejo nepoobla\u0161\u010denim osebam.<\/p>\r\n Pri uveljavljanju pravic iz tega naslova lahko uporabite tudi obrazec Informacijskega poobla\u0161\u010denca, ki je dosegljiv na njihovi spletni strani.
